Privacy Policy

This Privacy Policy (the "Policy") sets out how BitHills Inc. ("we", "us") handles user personal information in the services provided on this website (the "Service").

Article 1 — Definition of personal information

"Personal information" means personal information as defined under the Act on the Protection of Personal Information: information about a living individual that can identify a specific person by name, date of birth, address, telephone number, contact details or other descriptions. It also includes data relating to appearance, fingerprints or voiceprints, and identifiers such as health-insurance policy numbers that can identify an individual on their own (personal identification information).

Article 2 — How we collect personal information

We may collect personal information such as name, date of birth, address, telephone number, email address, identity documents (such as a driver's licence or passport), corporate registry information, wallet addresses and transaction records when a user applies for or uses the Service. We may also collect records of transactions between the user and us in the course of providing the Service.

Article 3 — Purposes of collection and use

We collect and use personal information for the following purposes:

  1. To provide and operate the Service
  2. To respond to user enquiries (including identity verification)
  3. To announce new features, updates and campaigns
  4. To notify users of maintenance and important notices
  5. To identify and restrict users who violate the terms of use or misuse the Service
  6. To let users view, change and delete their registered information and check usage
  7. To bill fees for paid services
  8. Purposes incidental to the above

Article 4 — Change of purpose

We may change the purpose of use of personal information only where the new purpose is reasonably deemed related to the purpose before the change. When a change is made, we will notify users by our prescribed method or announce it on this website.

Article 5 — Provision to third parties

We will not provide personal information to third parties without the user's consent, except in the following cases or where otherwise permitted by the Act on the Protection of Personal Information and other laws:

  1. Where necessary to protect a person's life, body or property and obtaining the person's consent is difficult
  2. Where particularly necessary to improve public health or promote the sound growth of children and obtaining the person's consent is difficult
  3. Where cooperation is required for a national agency, local government or their contractor to perform duties prescribed by law, and obtaining consent could impede those duties
  4. Where the following matters have been announced or published in advance and notified to the Personal Information Protection Commission:
    1. that the purpose of use includes provision to third parties
    2. the categories of personal information provided
    3. the means or method of provision
    4. that provision will stop at the person's request
    5. how such requests are accepted

The following recipients are not treated as third parties:

  1. Contractors to whom we provide personal information to the extent necessary for outsourced work
  2. Provision accompanying business succession
  3. Joint use with specified parties, where users have been notified in advance or the arrangement is readily available to them

Article 6 — Disclosure

When a person requests disclosure of their personal information, we will respond without delay. We may, however, refuse disclosure in whole or in part where:

  1. disclosure could harm the life, body, property or other rights and interests of the person or a third party;
  2. disclosure could significantly hinder the proper conduct of our business; or
  3. disclosure would otherwise violate laws or regulations.

We may charge a reasonable administrative fee for each disclosure request; the amount will be communicated before the request is processed.

Article 7 — Correction and deletion

Where a user's personal information held by us is inaccurate, the user may request correction, addition or deletion ("Correction") through our prescribed procedure. If, after reviewing the request, we determine it is necessary, we will respond promptly and notify the user of the result.

Article 8 — Suspension of use

Where a user requests suspension of use or deletion ("Suspension") on the grounds that their personal information is being handled beyond the purpose of use or was obtained improperly, we will investigate promptly and, where we deem it necessary, carry out the Suspension and notify the user of the result without delay. Where Suspension would involve significant cost or is otherwise difficult, we may instead take alternative measures that protect the user's rights and interests.

Article 9 — Changes to this Policy

Except for matters otherwise provided by law or in this Policy, this Policy may be amended without prior notice to users. Unless otherwise specified, the amended Policy takes effect when posted on this website.
